Rent Increases and Tenant Possession in Alanya: Prepare Your File
Start with the existing lease and separate your objectives
Prepare separate requests for a rent review and for possession of the property. A proposed rent change does not establish when the apartment will be available, and a date printed on a lease should not become an assumed moving-in date in your plans.
This guide is for owners with an existing long-term tenancy and buyers considering an occupied Alanya apartment. Its practical output is a document folder, a reconciled payment record and a focused request to Turkish tenancy counsel. It does not supply a current rent ceiling or determine a right to possession.
Write your objectives plainly: review the proposed renewal rent, understand a disputed payment, assess possible possession, or evaluate a purchase subject to the tenancy. Give each objective its own question and supporting documents.
Establish what was signed and what actually happened
Collect the complete lease, every amendment, annex and later agreement. Identify the named landlord, tenant, any other signatories and anyone acting for them. Ask counsel to confirm the lease classification and which documents govern the issue being reviewed; do not classify it from the property's appearance alone.
Record signature dates, the stated commencement date, actual handover evidence, amendments and the proposed renewal date separately. Keep original-language documents alongside translations, with page numbers preserved. For related document preparation, use the rental-contract guide at Renting Out a Turkish Property: Contract and Registration Checks.
Build a payment ledger showing each rental period, amount requested, amount received, receipt date, currency, bank reference and unresolved difference. Separate rent from deposits, reimbursements and other transfers. Label disputed allocations as disputed rather than treating your interpretation as an established arrears balance. Update the ledger whenever a payment, refund or allocation correction occurs, and reconcile it against bank records for each rental period. Record each transfer once; show any allocation across periods without counting the transfer again.
Complete a blank review worksheet before requesting advice
Use one worksheet per tenancy. Fill each blank with a document reference or write “missing”; do not leave uncertain dates looking confirmed. Repeat the payment row for every period under review. Record who supplied each document and when.

Verify the rent-review basis before communicating a figure
Ask counsel to distinguish an ordinary renewal review from any possible court rent-determination process. Request the applicable basis, relevant date, exact inputs and a written calculation for your file. Keep a proposed figure separate from a figure counsel has reviewed.
TÜİK provides an official statistics portal. A portal link alone does not identify the measure applicable to your lease. Ask the adviser to attach the exact bulletin or extract used and explain its relevance; this guide reproduces no current statistical figure.
If market comparisons are requested, label asking rents separately from documented tenancy evidence. Record property differences and collection dates. Do not treat an online listing as permission to impose its advertised rent on an existing tenant.
Build a separate possession and correspondence record
For a possession assessment, explain your actual purpose and attach the facts supporting it. If buying an occupied home, request the seller's tenancy file and ask counsel how the proposed acquisition affects your position before relying on access to the apartment.
Preserve messages, letters, attachments and delivery or service records. Distinguish a draft notice, a sent notice and evidence of receipt. Ask counsel what procedure and timing apply before sending a formal demand. Do not use lock changes or utility shutoffs to obtain possession.
If the file includes a document described as a tenant's commitment to vacate, often called an eviction undertaking, retain the complete original and record who signed, when, where and in what circumstances, including the handover context. Request an assessment of its effect; do not label it valid, invalid or a fast route from its title alone.
The Ministry of Justice publishes a mediation resource referring to rental disputes. Ask counsel whether mediation or another procedure applies to this file, what notices are needed and which actual professional quotations to obtain. The resource does not establish your case's procedure or duration here.
Test your ownership plan against unresolved possession
Keep received rent, proposed rent, legal quotations and possible accommodation or vacancy costs in separate budget lines. Mark unknown amounts as unquoted. The rental-income planning guide at Rental Income in Alanya: Build a Property Cash-Flow Plan provides a related planning topic; your tenancy file supplies the actual inputs.
Hypothetical example: an owner wants to use the apartment personally, while the tenant disputes a proposed increase. The owner prepares separate rent-review and possession questions, keeps alternative accommodation under consideration and does not treat agreement on rent as agreement to vacate. This illustrates a planning choice, not a predicted legal outcome.
Send a focused action request with the folder
Ask counsel: “Please confirm the lease classification, review the proposed rent basis, assess the separate possession objective, identify missing evidence and specify any actions or dates requiring attention.” Request written distinctions between confirmed facts, disputed facts and unanswered questions.
Send Ogenus your property reference, folder index and unresolved document requests to discuss what further property information may be available. Keep legal conclusions with the adviser reviewing the actual tenancy.
